Marijuana Bail Bonds

Posted on Apr 21st, 2017 by Super User 1674 Views

If you or a loved one are facing charges for marijuana, you may be asking yourself, “Wait a minute, didn't they just make marijuana legal in this state?” The answer is, Yes, personal, recreational use of marijuana, by adults, is legal. But, that doesn't mean that you'll never face legal complications, if you're in the habit of carrying it around with you.

Prop 64 – Adult Marijuana Use in California

On November 8, 2016, California voters said “Yes” to Proposition 64, paving the way for the recreational use of pot by adults. Adults are defined as being persons 21 years of age or older. California's marijuana law also makes it legal for weed to be sold in the state but only by licensed businesses. Therefore, anyone caught in possession of marijuana, in excess of a few ounces, or marijuana that is separated out into baggies for individual sale or distribution, can still be charged with violating Health and Safety Code 11359, if they do not also have a license to sell Marijuana in California. This code provides criminal penalties for people caught carrying, transporting, or selling marijuana without a license.

Can I be Arrested for Carrying Marijuana in California?

Since it is legal to use Marijuana, for medical or recreational reasons, you won't be arrested simply for having marijuana on your person. However, if the authorities can make a case that you are carrying marijuana, with the intent to sell it to someone else, or that you were intending to share it with someone underage, you can be arrested and charged with several different crimes, depending on the circumstances.

Marijuana Misdemeanor Charges - Misdemeanor HS11359

When marijuana became legal for personal and recreational use, it also became legal to sell marijuana but ONLY if you have a state-issued license to sell it. Violation of HS 11359 is possession of marijuana with the intent to sell it on the black market. This is a misdemeanor, for most defendants, and the penalties for possession, with the intent to sell on the black market, are up to six months in county jail or a fine of up to $500.

Marijuana Felony Charges - Felony HS11359

  • Under certain circumstances, the authorities can charge a defendant with a felony violation of HS11359, by charging them with possession of marijuana with the intent to sell it without a license. Selling without a license is a much more serious offense and carries with it much steeper fines and punishments.
  • A person might be charged with felony possession of marijuana if:
  • The person has multiple prior drug convictions.
  • Persons with serious, violent, or sex crimes convictions.
  • The arrest occurred in connection with a sale or attempted sale.
  • The sale was being made to a person under the age of 18.
  • The offense involves someone, over 21, employing or using a person twenty years of age or younger in producing, cultivating, or marketing marijuana.

What Happens If I Get Arrested For Possession Of Marijuana?

Being arrested means that you are taken into custody by a police officer or other member of law enforcement. When you are arrested or detained, you are not required to answer any questions, other than to give your name and address and produce identification, if requested.

Once you are arrested, the officer should inform you of your rights.

  • You have the right to remain silent – They can't make you talk.
  • Anything you say can be used against you – If you choose to talk to the authorities, the statements you make can be used against you in court.
  • You have the right to an attorney – You can ask to have an attorney present while they question you. If you ask for an attorney but continue to talk to the officers, while you wait for your attorney, the answers you give can still be used against you.
  • If you cannot afford an attorney, one will be appointed for you – If you cannot afford an attorney, but would like to have one, the court will appoint an attorney for you, free of charge.

Once you have been arrested, you will be transported to whichever detention facility is used by the arresting officers. Once there, you will be booked and charged with a specific crime. You will be allowed to make up to three free phone calls. You should use these calls to arrange for a marijuana bail bond so you can get out of jail fast.
